of Class Action Lawsuit; 1 $15 off Future Night's Stay for all Consumers Charged an Energy Surcharge |
May 30, 2002 - While Wyndham International cannot directly comment
on the complaint brought forward by the Florida State Attorney General's
Office, it is important to note that Wyndham recently entered into a nationwide
class-action lawsuit settlement agreement providing relief for all consumers
charged an energy surcharge while staying at Wyndham properties throughout
the U.S., including Florida.
Wyndham does not believe any of its acts were inappropriate, but agreed to settle the dispute merely to dispose of the litigation. The basic terms of the settlement are that each person who paid an energy surcharge will be entitled to a coupon for $15 off a future night's stay, and if Wyndham charges such a surcharge in the future, the surcharge will be disclosed at the time of reservation. If the redemption rate of these coupons is less than 6 percent, Wyndham will make up the difference by donating room nights, conference rooms, ballrooms or the equivalent to charitable or governmental entities; provided, however this amount in no case will exceed $1.5 million. Florida residents along with any other persons charged an energy surcharge will be made whole through this settlement agreement and further litigation in this matter brought on by the Florida Attorney General's office only seeks to financially benefit the Florida Attorney General's office and not the consumer. Additionally, Wyndham entered into an Assurance of Voluntary Compliance with the Texas Attorney General agreeing to the same basic terms of the nationwide class settlement. |
